Under Articles 15 and 18 of the regulation, manufacturers have a legal obligation to draw up an EU Declaration of Conformity (Art. 39, Annex VIII), accompanied by technical documentation (Annex VII), before placing products on the market. Without these documents, packaging is not considered legally placed on the market. Article 62 allows authorities to ban distribution or order withdrawal from shelves, while Article 68 requires member states to adopt, by February 12, 2027, fines that are “effective, proportionate and dissuasive.” More and more retailers are already requiring suppliers to provide the standardized Annex VIII format before listing products, so a company without it risks losing shelf space, not just paying a fine.
